TERMS AND CONDITIONS OF USE

Introduction

Welcome to the Michigan Public Transit Association Website.  The Michigan Public Transit Association (the “MPTA”) is a non-profit statewide association incorporated in 1977 under Section 501(c)6 of the Internal Revenue Code.  The MPTA was first organized in 1974, and its membership ranges from the largest urban public transit system providers in Michigan to a majority of the smaller rural demand-response systems in the state.  This Site is intended to provide education and information to MPTA members and the general public.

Acceptance of Terms

The various web pages and information contained at www.mptaonline.org (the “Site”) are operated by the MPTA. Your access and use of the Site constitutes your acceptance to be bound by the terms and conditions contained herein (“Terms”).  You are bound by these Terms whether or not you are a registered “Member” of the Site.  The MPTA reserves the right to change or modify these Terms from time to time.  Any such change or modification shall be posted on this page.  It is your obligation to determine whether any changes or modifications to the Terms have been made and your continued access and use of the Site subsequent to any change or modification constitutes your acceptance of the same.

The information on the Site is for informational purposes only.  It is believed to be reliable, but the MPTA does not warrant the accuracy, completeness, currency, or usefulness of the information, text, graphics, links, products, processes, services, and/or other items contained in the Site.

Outside Links

Any link from the Site to an external website does not imply or mean that the MPTA endorses or accepts any responsibility for the content or the use of such website.  The MPTA does not make any representation regarding the quality, safety, suitability, or reliability of any external websites or any of the content or materials contained in them. It is important for users to take necessary precautions, especially to ensure appropriate safety from viruses or other potentially harmful or destructive programs.

MPTA Technician’s Toolbox

THE INFORMATION FOUND IN THE TECHNICIAN’S TOOLBOX PORTION OF THE SITE IS FOR INFORMATION PURPOSES ONLY, IT IS NOT TO BE USED AS A SUBSTITUTE FOR A THOROUGH DIAGNOSTIC INSPECTION.  NO REPAIR AND/OR RESOLUTION SUGGESTED ON THIS SITE SHOULD BE ATTEMPTED WITHOUT A THOROUGH KNOWLEDGE OF THE MECHANICS OF THE SUGGESTED REPAIR AND/OR RESOLUTION AND THE RISK INVOLVED.  THE PURPOSE OF THIS SECTION OF THE SITE IS TO PROVIDE EDUCATION AND INFORMATION TO THE MPTA’S MEMBERS.  NO CLAIM OR GUARANTEE IS MADE, NOR INTENDED, WITH RESPECT TO THE SAFETY, POTENTIAL FOR SUCCESS, POTENTIAL FOR DAMAGE OR THE RISK ASSOCIATED WITH ANY REPAIR AND/OR RESOLUTION SUGGESTED ON THIS SITE.  YOUR USE OF THE INFORMATION CONTAINED HEREIN IS AT YOUR OWN RISK.

Privacy Policy

The MPTA prides itself on protecting your privacy.  This Privacy Policy is intended to inform users about MPTA policies and procedures regarding the collection, use, security, and disclosure of personally identifiable information received from users of the Site. The MPTA uses information you provide to better understand your needs and provide you with better service.  The MPTA collects information from you. including but not limited to, information from you regarding your Membership application, information relating to your attendance at MPTA events, and information regarding your requests for information. The MPTA does not disclose, sell or rent any of your personally identifiable information to any third party unless approved by you or required by law.

Cookies

The Site may ask your browser to store a “cookie” which is a small piece of information that the web server uses to keep track of the use preferences. Cookies are not used to save or retrieve any sensitive data about visitors to the Site.

MPTA’s Commitment to Data Security

To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, the MPTA uses commercially appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect online. Unfortunately, the transmission of information via the Internet is not completely secure. The MPTA has put in place various security procedures as set out in these Terms. Although the MPTA does its best to protect your personal data, it cannot guarantee the security of your data transmitted to the Site; any transmission is at your own risk. Once the MPTA has received your information, it will use strict procedures and security features to try to prevent unauthorized access.

Children’s Privacy

The MPTA does not seek to collect or maintain information on the Site from those we know are under 18.

Submission of Articles

The MPTA no longer publishes a hard copy newsletter. The MPTA does, however, put articles of general interest on the Members Section of the Site and it does welcome both solicited and unsolicited content.  The MPTA accepts content in PDF, Microsoft Word, or Microsoft Publisher formats. The MPTA does not provide payment for materials used, but electronic publication the Site may lead to future business opportunities with MPTA members.

The MPTA does not claim ownership of the content you provide to us (including information posted in the Technician’s Toolbox portion of this Site).  However, by submitting content or posting on the Technician’s Toolbox portion of the Site, you are granting the MPTA and any necessary sub-licensees, permission to use your content in connection with the operation of the Site, without limitation, the rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your content; and to publish your name in connection with your content.

By submitting content you warrant and represent that you own or otherwise control all of the rights to your content as described in this section including, without limitation, all the rights necessary for you to provide the MPTA said content.

Copyrights

Content included on the Site, such as text, graphics, logos, button icons, images, audio clips, software, and compilation (meaning the collection, arrangement, and assembly) of all content on this Site is the property of the MPTA, or its content suppliers and are protected by the Untied States and international copyright laws. Any reproduction, modification, distribution, republication, display, or performance of the content of the Site is strictly prohibited. You may not copy, download, reproduce, modify, publish, distribute, transmit, transfer, or create derivative works from the content, nor any portion thereof, without first obtaining written permission from the MPTA.  The MPTA does not represent nor warrant that your use of the content and materials on this Site will not infringe the rights of third parties.

THE MPTA MAKES NO WARRANTIES OR REPRESENTATIONS, EXPRESS OR IMPLIED THAT (1) THE INFORMATION PROVIDED THROUGH THE SITE WILL BE FREE FROM ERROR, OMISSION, INTERRUPTION, DEFECT, OR DELAY IN OPERATION, OR FROM TECHNICAL INACCURACIES OR TYPOGRAPHICAL ERRORS; (2) THAT THE SITE WILL BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (3) THAT DEFECTS OR ERRORS IN THE SITE WILL BE CORRECTED; OR (4) THAT THE CONTENT ON THE SITE WILL BE FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

Limitations

You agree that under no circumstances will the MPTA be liable for any direct, indirect, consequential, special, exemplary, punitive or other damages, including but not limited to, lost profits, costs or attorney fees, arising out of or relating to your use of the Site, under any legal theory, including but not limited to breach of contract, breach of warranty, defamation, negligence, or strict liability.

IN THE EVENT THAT YOU HAVE A DISPUTE WITH ANOTHER USER RELATED TO, ARISING FROM, OR IN ANY WAY CONNECTED WITH YOUR USE OF THE SITE, YOU RELEASE THE MPTA FROM ANY AND ALL CLAIMS, DEMANDS, AND DAMAGES OF EVERY KIND AND NATURE ARISING OUT OF OR IN ANY WAY CONNECTED WITH SUCH A DISPUTE, AND AGREE TO INDEMNIFY AND HOLD HARMLESS THE MPTA IN CONNECTION WITH ANY SUCH DISPUTE.

Governing Law

These Terms are governed under the laws of the sate of Michigan exclusive of its choice of law rules and matter affecting copyrights, trademarks, and patents under the Untied Sates Federal law.  You hereby irrevocably and unconditionally consent to submit to the jurisdiction of the courts of Ingham County, Michigan for any dispute.
